Terms of Service

1.Who we are

HealthWise is operated by HealthWise LLC ("HealthWise", "we", "us"). These Terms of Service ("terms") are a contract between you and HealthWise LLC covering your use of the website at https://healthwise.us.com and everything offered through it (together, the "service").

2.Agreeing to these terms

By using the service, creating an account, or buying a subscription, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. If you use the service on behalf of an organization, you confirm you have the authority to bind that organization to these terms.

3.What HealthWise is, and what it is not

Our lessons, glossary, cost estimates, comparisons, and recommendations exist to help you understand your options. They are based on the information you give us and on general knowledge about how health plans work. They can be wrong, incomplete, or out of date. Always confirm the details that matter, such as whether a doctor is in network or what a procedure costs, with your insurer, employer, or provider before you act.

4.Who may use the service

You must be at least 18 years old and able to form a binding contract to create an account. The service is designed for people in the United States; we make no promise that it is appropriate or available anywhere else.

5.Your account

You are responsible for your account: keep your password private, keep your email address current, and tell us right away at sales@healthwise.us.com if you think someone else has used your account. Give us accurate information; entering someone else's details as your own is not allowed. You may delete your account at any time from your account page, which permanently removes your data as described in the Privacy Policy.

6.Free and Premium

The video lessons and glossary are free, with or without an account. Premium is a paid yearly subscription that adds personal features: adding your own plans, cost estimates, comparisons, a recommendation, and answers about your own documents. What each tier includes is listed on the pricing page; we may change the feature list over time as the product evolves.

Enterprise offerings for employers, brokers, and health plans are governed by a separate written agreement, which controls where it conflicts with these terms.

7.Billing, auto-renewal, and refunds

Payments are processed by Stripe; your card details never touch our servers. Prices are in U.S. dollars. You are responsible for any taxes that apply to your purchase.

8.Cancelling

You can cancel any time from the billing portal on your account page, or by emailing sales@healthwise.us.com. Cancelling stops the next renewal; you keep Premium until the end of the period you already paid for. Except for the refund window above, cancelling does not refund the current period.

9.Your content and plan documents

The documents you upload, the plan details you type in, your questionnaire answers, and your notes remain yours. You give us only the limited license needed to operate the service for you: to store them, process them (including with AI, as described in the Privacy Policy), and show them back to you.

We never use your documents or answers to train AI models, never sell them, and never show them to other members. You can delete an upload, or your whole account, at any time. Only upload documents you have the right to share, such as your own benefits materials.

10.Acceptable use

Do not:

• break the law, or use the service to harm anyone;
• share your account, or access someone else's;
• probe, scrape, overload, or interfere with the service, or try to get around its security or its access rules;
• copy, resell, or redistribute the lessons, glossary, or other content, except as allowed by a written agreement with us;
• upload malware, or content you have no right to share;
• misrepresent HealthWise output as licensed professional advice.

We may suspend or close accounts that break these rules.

11.AI features

Parts of the service, such as reading your plan documents, the recommendation, plan Q&A, and the help assistant, use artificial intelligence. AI output can be wrong or incomplete even when it sounds confident, and it carries the same educational-only status as the rest of the service. Check anything important against the source document or your insurer before you rely on it.

12.Our content

The service and its content, including the lessons, glossary, text, design, and software, belong to HealthWise LLC or its licensors and are protected by intellectual-property laws. We give you a personal, non-exclusive, non-transferable right to use the service for your own, non-commercial benefit while these terms apply. Videos are hosted on YouTube and also subject to YouTube's terms.

13.Third-party services and links

The service is built on third-party services, such as Stripe for payments and YouTube for video playback, and may link to outside sites, such as HealthCare.gov. We do not control third parties and are not responsible for their content, terms, or privacy practices. The processors we use for your data are listed in the Privacy Policy.

14.Medical and insurance disclaimer

Nothing on HealthWise is medical care, a diagnosis, treatment, or a substitute for advice from a licensed clinician, and nothing on HealthWise is licensed insurance advice or a guarantee about what any plan covers or costs. Plan documents, networks, formularies, and prices change; your insurer's own documents and representatives are the authority on your coverage. If you have a medical emergency, call 911.

15.No warranties

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be accurate, uninterrupted, or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

16.Limit on our liability

To the fullest extent the law allows: HealthWise LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, savings, or data, arising from the service, and our total liability for all claims together is capped at the greater of the amount you paid us in the 12 months before the claim or $50. This includes decisions you make, such as choosing a health plan, based on information from the service. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

17.Indemnification

You agree to defend and hold HealthWise LLC harmless from claims and costs, including reasonable attorneys' fees, that arise from your content, your use of the service in violation of these terms, or your violation of the law or of someone else's rights.

18.Suspension and termination

You may stop using the service, and delete your account, at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we discontinue the service; if we end a paid subscription for convenience, we will refund the unused part of the period you paid for. Sections that by their nature should survive, such as the liability limits and disputes sections, survive termination.

19.Changes to the service or these terms

We are a young product and the service will change, including features being added, reshaped, or retired. We may also update these terms; when a change is material we will give notice, such as by email or a notice on the site, before it takes effect. Using the service after a change takes effect means you accept the updated terms. The current version always lives at https://healthwise.us.com/terms.

20.Governing law and contact

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before filing a claim, contact us at sales@healthwise.us.com; most concerns can be resolved quickly and informally. If a court finds part of these terms unenforceable, the rest still applies; if we do not enforce a provision, that is not a waiver.
